The terms governing access to and use of Image-to-Prompt.org

1. Agreement and Operator Information

These Terms of Service (Terms) govern access to Image-to-Prompt.org and its image-analysis, Prompt-generation, account, History, credit, subscription, and related services (collectively, the Service).

By accessing or using the Service, creating an account, or purchasing a plan or credit package, you agree to these Terms and acknowledge our Privacy Policy and Cookie Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old and meet the minimum digital-consent age in your jurisdiction. If you are under the age of legal majority, a parent or legal guardian must approve your use. You must be legally capable of entering a binding contract to make a purchase.

If you use the Service for an organization, you represent that you have authority to bind that organization, and you includes the organization.

3. What the Service Does

The Service analyzes an image supplied as a file or public URL and generates a visual analysis plus six independently written Prompt formats: General, Midjourney, FLUX, Stable Diffusion, ChatGPT Image, and Nano Banana. It may allow signed-in users to edit, save, copy, and delete results and eligible paid users to analyze multiple images in a batch.

The Service does not recover the original Prompt used to create an image and does not verify actual camera, lens, lighting, or EXIF data unless expressly stated. Visual-deconstruction fields are AI inferences. The Service does not generate an image itself, and a Prompt cannot guarantee that another platform will reproduce the reference image.

Third-party image platforms are independent services governed by their own terms. Links to them do not mean that they sponsor or endorse the Service.

4. Accounts

You must provide accurate information, protect your password and account, and promptly notify us of suspected unauthorized use. You are responsible for activity conducted through your account unless applicable law provides otherwise.

We may require email verification, apply rate limits, revoke sessions, or suspend access to protect the Service. You may delete your account through security settings. Before the account and its History records are removed, the Service requests deletion of the R2 image objects associated with that History. If an image-object deletion fails, the account is kept so the operation can be retried. Some transaction records may remain where required by law, as explained in the Privacy Policy.

5. Credits and Usage

  • One successfully analyzed image ordinarily consumes one credit and returns all six Prompt formats.
  • Unsupported files, safety rejections, and final processing failures should not consume a credit. If a credit is reserved and processing fails, the Service will attempt to return it.
  • Anonymous users may try up to three free analyses once per browser. A first-party cookie and server-side usage record enforce this trial, which does not reset daily.
  • New accounts receive five permanent registration credits once. Registered accounts do not receive daily free credits. Batch analysis requires an active Pro subscription.
  • The number, expiration, and renewal schedule of paid or promotional credits are the values displayed on the pricing or checkout page when obtained.

Credits are a limited, revocable license to use designated Service features. They are not money, stored value, a deposit, or property; do not earn interest; have no cash value; and cannot be transferred, resold, or withdrawn. Credits may expire according to the offer under which they were issued. Expired, promotional, or unused credits are not refundable except where required by law.

We may correct a credit balance affected by fraud, chargeback, duplicate grant, technical error, or refunded transaction. We will not retroactively reduce validly purchased credits merely because future pricing changes.

6. Prices, Payments, and Taxes

Prices and included credits are displayed before purchase. You authorize the applicable charge and any recurring charge shown at checkout. Prices may change for future purchases or renewal periods after reasonable notice; a change does not alter a completed one-time purchase.

Creem acts as merchant of record and contractual seller for checkout, invoicing, payment collection, indirect taxes, and related payment administration. Creem, rather than the Service, collects full payment details. Your purchase is also subject to the Creem Buyer Terms and Creem Privacy Notice.

You are responsible for taxes not collected by Creem and for keeping billing information current.

7. Subscriptions, Cancellation, and Refunds

Subscriptions renew automatically at the interval and price disclosed at checkout until canceled. You may manage or cancel a subscription through the Creem customer portal. Unless the portal states otherwise, a scheduled cancellation takes effect at the end of the current paid period, and access may continue until then.

Except where required by law or expressly stated at checkout, completed charges and consumed credits are non-refundable. For duplicate charges, service failures, or an unused purchase you believe should be refunded, contact [email protected] promptly with the transaction information. We determine product-refund eligibility, and Creem may technically process an approved refund or chargeback.

Nothing in these Terms limits mandatory cancellation, withdrawal, refund, or consumer rights that cannot legally be waived. If local law gives you such a right, it applies according to that law.

8. Your Images, URLs, and Prompts

You retain any rights you have in content you submit. You grant us and our service providers a worldwide, non-exclusive, royalty-free license to host, copy, transmit, resize, display, analyze, moderate, and otherwise process that content only as reasonably necessary to provide, secure, support, and comply with law in connection with the Service.

You represent that:

  • you own the content or have all permissions needed to submit and process it;
  • a submitted URL is public and may lawfully be retrieved by our server;
  • the content and its processing do not violate privacy, publicity, copyright, trademark, confidentiality, contractual, or other rights; and
  • you have appropriate authority to submit images of children or other people.

After successful analysis, images are stored through Cloudflare R2 at a publicly reachable URL for result and History display. Do not submit trade secrets, confidential documents, intimate images, authentication credentials, or other content that should not be accessible to anyone who obtains the URL. The Service requests deletion of the corresponding R2 object when you delete a History entry or account. An anonymous result and its image are deleted after the result expires and a subsequent cleanup operation runs. Previously accessed copies may remain briefly in browser or intermediary caches after deletion.

9. AI Outputs

To the extent permitted by applicable law and subject to third-party rights, you may use generated Prompts for personal or commercial purposes. Outputs are not exclusive; other users may receive similar text. We do not guarantee that an output is copyrightable, registrable, original, accurate, complete, safe for a particular use, or free from third-party claims.

You are responsible for reviewing outputs and for complying with the rules of the platform where you use them. Do not rely on the Service for medical, legal, financial, employment, law-enforcement, biometric-identification, or other high-impact decisions.

Before delivering a six-Prompt package, we submit its text to the Creem Moderation API. We block the package if Creem returns flag or deny, or if the moderation service does not return a valid allow decision. Moderation is an additional safeguard, not a guarantee that every allowed output is lawful, accurate, appropriate, or accepted by another platform.

10. Prohibited Use

Adult and NSFW Content

You must not use the Service to generate, obtain, edit, save, share, distribute, or otherwise facilitate Prompts intended to produce adult, NSFW, pornographic, sexually explicit, sexually suggestive, or otherwise sexually oriented content. This prohibition applies to uploaded images, image URLs, Prompt generation, Prompt editing, saved Prompts, and use of outputs on third-party platforms.

Attempts to evade this restriction through indirect wording, euphemisms, encoding, misspellings, or other obfuscation are also prohibited. Content that sexualizes, exploits, endangers, or depicts the sexual abuse of a minor is strictly prohibited and may be reported to the appropriate authorities.

You must not:

  • violate applicable law or another person's rights;
  • submit unlawful, exploitative, non-consensual intimate, privacy-invasive, hateful, or severely graphic content;
  • sexualize minors or submit child sexual abuse material;
  • impersonate another person or create deceptive, fraudulent, or harmful media;
  • upload malware or attempt to compromise, probe, overload, or disrupt systems;
  • bypass safety, rate-limit, credit, authentication, payment, or subscription controls;
  • scrape the Service, automate access outside provided interfaces, resell access, or reverse engineer protected systems except where law expressly permits; or
  • use an output to misrepresent its origin or authenticity where disclosure is required by law.

We may reject or remove content, preserve evidence, report apparently illegal material, and suspend or terminate accounts when reasonably necessary for safety, legal compliance, or enforcement of these Terms.

11. Service and Account Changes

We may update models, providers, supported platforms, credit offers, limits, or features. We may suspend the Service for maintenance, security, provider failure, legal compliance, or circumstances beyond reasonable control.

We may suspend or terminate an account for a material or repeated breach, fraud, nonpayment, security risk, or unlawful use. Where practical and lawful, we will provide notice and an opportunity to remedy. You may stop using the Service at any time.

Provisions that by their nature should survive termination, including payment, ownership, disclaimers, liability, and dispute provisions, will survive.

12. Our Intellectual Property

The Service, branding, interface, software, documentation, curated examples, and other materials we provide are owned by us or our licensors and protected by applicable intellectual-property laws. These Terms give you only the limited right to use the Service as intended; they do not transfer our intellectual property.

Feedback may be used without restriction or payment, provided we do not publicly identify you as its source without permission.

13. Disclaimers

To the maximum extent permitted by law, the Service is provided as is and as available. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, and warranties arising from course of dealing. We do not warrant uninterrupted availability, perfect security, exact image reproduction, or error-free AI outputs.

These disclaimers do not exclude warranties or consumer guarantees that cannot legally be excluded.

14. Limitation of Liability

To the maximum extent permitted by law, neither the Service operator nor its affiliates, personnel, or suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, or business interruption.

Our aggregate liability arising from the Service will not exceed the greater of the amount you paid us for the Service during the 12 months before the event giving rise to the claim or USD 100.

These limits do not apply to liability that cannot legally be limited, including where applicable liability for fraud, willful misconduct, or death or personal injury caused by negligence. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply to you.

15. Business-User Indemnity

If you use the Service on behalf of a business, you will defend and indemnify the Service operator and its affiliates against third-party claims arising from your submitted content, unlawful use, or material breach of these Terms, except to the extent caused by our own breach or misconduct. This section does not apply to consumers where prohibited by law.

16. Governing Law and Disputes

These Terms will be governed by the laws of the People's Republic of China, without regard to conflict-of-law rules, and disputes will be brought before the competent courts in Tongxiang City, Zhejiang Province, People's Republic of China.

This choice does not deprive a consumer of mandatory protections or the right to bring a claim in another forum where applicable law requires it. Before filing a claim, the parties should attempt in good faith for 30 days to resolve the issue by contacting the email address below.

17. Changes and General Terms

We may update these Terms. Material changes will take effect on the date stated in the notice or, if no later date is stated, when posted. Continued use after the effective date constitutes acceptance where permitted by law. Changes will not retroactively alter a completed purchase or dispute without your agreement.

If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. Failure to enforce a provision is not a waiver. You may not assign these Terms without consent; we may assign them as part of a merger, reorganization, or transfer of the Service, subject to applicable law.
